1. Conclusion of a contract
The offer of products is non-binding; as a customer you submit a binding order to buy by clicking the order button as the last step of the ordering process. This order to buy is accepted automatically by way of a confirmation e-mail (“order acknowledgement”). If “cash in advance” has been agreed, we are authorized to request you to pay by a bank transfer within ten working days, failing which the order is automatically deleted from our system. You will be informed of this by an e-mail. The text of the Contract is included in the acknowledgement mail and is also filed in the system of BFB Handels GmbH. It cannot be viewed online but may be furnished on request, solely by e-mail.

2. Product prices
The prices for all products available on http://www.youtailor.eu/ are inclusive of 20% Austrian VAT. In the event that the Austrian VAT rate should change we reserve the right to change the prices accordingly. Apart from the stated total price, customers of BFB Handels GmbH are not billed any further surcharges, except for the shipping costs which are stated separately for each order. Products are shipped without any customs clearance charges only within the European Union.

3. Validity of the contract
This contract is valid only for as long as there is no additional agreement confirmed either in writing or by electronic means between the customer (yourself) and BFB Handels GmbH. For any other agreement we would ask you to contact and inform us prior to placing your order.

4. Payment of the products
You have the choice of four payment modes:

Your purchase order will be processed once the value of the order has been fully paid and the amount payable received in our account. If the credit card payment mode is chosen, the amount payable is debited directly from your credit card.

5. Security and cookies

BFB Handels GmbH does not use any cookies which would allow any third party to make use of your account or trace your personal web surfing habits. Cookies are needed only to identify the products in your basket. Third-party cookies are used only to develop statistics on the use of our web pages. They do not carry any personal information. All transactions with banks are encrypted.

6. Delivery/shipping cost
Our hand-made shirts, blouses, suits and boxer shorts are normally delivered within three to five weeks. However, this delivery period cannot be guaranteed. In some cases, delivery may be delayed by a few days when the desired fabric is not available. We make every reasonable effort to deliver in good time. 7. Right of cancellation and its consequences

You may cancel the contract concluded by you within two (2) weeks without stating any reasons, either in wording (e.g. by letter, fax or e-mail) or, if the product is surrendered to you before expiry of the time limit, by returning the product. The time limit commences upon receipt of this information pursuant to Section 5e of the Austrian Consumer Protection Act, but not before receipt of the product by the addressee or – in the event of repeat deliveries of similar products – not before receipt of the first part shipment, and not before we have performed our information obligations. The time limit is observed when the cancellation is received or the product is returned in good time before its expiry, addressed to BFB Handels GmbH, Universitätsstrasse 6/2, A-1090 Vienna. For a cancellation to be effective, either side must return the performance (product or payment) received. If you fail to return the product or return it in a deteriorated condition, you need to pay an adequate compensation. This does not apply for the surrender of goods if the deterioration of the product can be attributed solely to the inspection thereof in a manner similar to inspecting a product personally in the shop. Otherwise, you can avoid payment of a compensation for any deterioration caused by using the product as intended by not using such product as if it were your property and refraining from anything that might impair its value. Products that can be returned as parcels must be returned at our cost and risk. Payment obligations must be met within thirty (30) days. For you, the time limit starts upon sending your cancellation note or the product; for us, it starts upon its receipt.

8. Important notice: under Section 5 (f) 3 of the Austrian Consumer Protection Act, individually produced products (such as, for instance, custom-made shirts, custom-made blouses, custom-made suits and custom-made boxer shorts) are excluded from the right of cancellation!

9. Allowances

Shirts, blouses, suits and boxer shorts made by BFB Handels GmbH are always tailored in accordance with the measurements specified by you. If you have selected body measurements, your shirts, blouses and suits are matched to the fit chosen by you (close-fitting at the waist, fitting at the waist, normal, loose-fitting). If you select measurements taken from an existing piece of apparel, the dimensions of your new piece (shirt, blouse, suit) should match those of your old piece (shirt, blouse, suit). However, we cannot warrant that the two pieces will be identical in the run of the seams and design. Please note that adjustments in size of up to 1 cm may be necessary. We do not guarantee that the pieces ordered by you from the standard sizes of our tables will offer a perfect fit. For this reason we recommend that you use personal measurements, both body measurements and measurements taken from an existing piece. We make every effort to continually improve the quality and design of our pieces and our web page. For this reason pieces ordered at different times may be slightly different from each other. Pieces made from different batches of fabric may vary in their shading, due to normal variations in the dyeing process. If other problems than those outlined here should occur we will make every effort to remedy them as soon as possible as we wish to render the best possible service to you.

11. Legal warranty

Warranty for our products is in line with the statutory requirements. If a fault occurs within the statutory warranty period of two (2) years upon delivery, you are entitled to a supplementary performance (choice of correction of fault or new product) and – subject to application of the statutory prerequisites – the statutory right of reduction of the purchase price or rescission, and, if appropriate, damages. If the measurements or design of the piece do not match the specified measurements for reasons other than those stated above we will offer you a new piece or credit the amount to your customer account. BFB Handels GmbH credits the cost of returning the piece to your customer account if you send the piece in its original packaging using the cheapest possible shipping method. As our customer you are responsible for the measurements stated by you.

12. Customer account credit

No credit on your customer account will be paid out in cash or transferred to any third party.

13. Data on personal features

Any data on personal features of our customers are used solely to manage our customer relations; no personal data or e-mail addresses are passed on to any third party.

14. Data privacy, change of address and copyright issues

The customer consents to having any personal data included in the purchase contract for the performance of this contract computer-filed and processed by us. The customer undertakes to notify us of any change in his/her business or residential address for as long as the contractual transaction has not been fully performed by both sides. If such notification is not made, any statements given are deemed to be received when they are sent to the address last notified. Any drawings, sketches and other technical documents remain our intellectual property at all times, as do samples, catalogues, leaflets, pictures, etc.; the customer is not granted any right whatsoever to use or exploit the work.

15. Force majeure

In case of force majeure, the contract may be deemed to be annulled without any claim for compensation for BFB Handels GmbH or the customer or, alternatively, the delivery period may be extended to reflect the type of force majeure. For BFB Handels GmbH, cases of force majeure are: war, mobilization, terrorist act, stoppage of work, obstruction of transport, restricting trade policies, strike, failure of or delay in deliveries by suppliers of BFB Handels GmbH, natural disaster and, generally, any circumstance, event, cause or consequence beyond our control.

16. Applicable law, jurisdiction

This contract shall be governed by Austrian law. Applicability of the UN Sales Convention shall be explicitly excluded. The contractual language shall be German. The contracting parties agree to Austrian jurisdiction. Any dispute arising from or in connection with this Contract shall be settled by such court as is competent as regards the subject matter for the domicile of BFB Handels GmbH and solely locally competent.

17. Severability

Should any of the provisions hereof be invalid or unenforceable, the remaining provisions shall remain valid and the Parties shall replace such a provision with another provision the purpose of which shall be as close as possible to the original intention of the Parties.
